General Terms and Conditions (GTC)
Nomad Travel Connectors
Frankfurt am Main, August 08, 2025

1. Contractual Relationship
Nomad Travel Connectors, represented by Norman Smith, 60435 Frankfurt am Main (hereinafter referred to as “Nomad Travel Connectors”), may act in the following roles:

  1. Travel Agent / Intermediary – Arranging individual travel services or combined offers on behalf and for the account of the respective service providers (e.g., hotels, venues, transport companies, tour operators).

  2. Tour Operator – Organising its own package tours, where multiple travel services are combined into a single package and offered under its own name (§ 651a BGB – German Civil Code).

  3. Destination Management Company (DMC) – Planning, organising, coordinating and implementing business travel, group travel, and MICE events (Meetings, Incentives, Conferences, Exhibitions).

The specific role of Nomad Travel Connectors will be clearly communicated to the client prior to conclusion of the contract.

2. Special Provisions when Acting as a Tour Operator
If Nomad Travel Connectors acts as a Tour Operator, the provisions of German package travel law (§§ 651a ff. BGB) apply.

  • The client will receive a Security Certificate (Sicherungsschein) pursuant to § 651r BGB when booking a package tour.

  • The Security Certificate protects, in the event of Nomad Travel Connectors’ insolvency, against the loss of payments made and covers necessary repatriation costs.

  • The guarantor is R+V Allgemeine Versicherung AG, Raiffeisenplatz 1, 65189 Wiesbaden, Germany.

  • The guarantor’s liability is legally limited to EUR 1 million per insolvency case. If this amount is insufficient for all travellers, individual claims will be reduced proportionally.

  • The statutory rights under § 651r (4) BGB apply directly against the guarantor.
     

3. Services Provided and/or Arranged by Nomad Travel Connectors
Nomad Travel Connectors provides and/or arranges, among others:

  • Venues and conference rooms for MICE events

  • Group hotel and accommodation bookings

  • Business and leisure travel arrangements

  • Organisation and implementation of package tours (as a tour operator)

All providers are selected with the greatest care.

4. Conclusion of the Contract
The offers displayed on the website or through other communication channels do not constitute a binding contractual offer by Nomad Travel Connectors.
By submitting a booking request, the client makes a binding offer. The contract is concluded once Nomad Travel Connectors confirms acceptance in text form.

5. Payment Processing
Nomad Travel Connectors is authorised to receive payments on behalf of the service provider if expressly agreed. Otherwise, payment is made directly to the respective service provider.
The payment terms are based on the general terms and conditions of the respective service provider.
The client is obliged to adhere to the payment deadlines specified therein.
In case of returned direct debits or incomplete payments, the service provider reserves the right to cancel the contract or charge additional fees.

5.1 Payment Processing via Stripe
Unless otherwise agreed, payment processing is carried out via the external payment service provider Stripe Payments Europe, Ltd. (“Stripe”).

  • Stripe is responsible for secure and encrypted processing of the payment transaction.

  • Payment data is stored and processed exclusively by Stripe; Nomad Travel Connectors has no access to full payment details such as credit card numbers.

5.2 Project-Based Advance Payments
For extensive DMC services (e.g., reservations for venues or service providers), Nomad Travel Connectors is entitled to request project-based advance or partial payments as agreed in the offer or contract.
The payment obligation remains valid even in the event of postponement or cancellation of the event by the client, unless otherwise agreed.

6. Cancellations and Rebookings
Cancellations and rebookings must be arranged directly with the respective service provider and are subject to their terms and conditions.
Any resulting fees shall be borne by the client.
Nomad Travel Connectors will assist the client with communication but assumes no liability for any resulting costs or consequences.

7. Client Obligations
The client must promptly check booking confirmations and travel documents for accuracy and report any discrepancies immediately.
7.1 Air Travel
The client is responsible for obtaining information about entry, transit, and exit regulations – in particular any required (transit) visas.
Valid information can be obtained from the respective embassies or consulates; an overview is available on the website of the German Federal Foreign Office (www.auswaertiges-amt.de).
The client is also responsible for complying with airline requirements such as check-in times, reconfirmation of return flights, and related matters.
Failure to comply may result in the loss of the right to carriage.
Refunds for partially unused tickets are not possible.

8. Liability
8.1 Liability as a Travel Agent
Nomad Travel Connectors is liable solely for the proper arrangement of booked services.
Responsibility for the execution of arranged services lies solely with the respective service provider.

8.2 Liability as a Tour Operator
When acting as a Tour Operator, Nomad Travel Connectors is liable within the framework of the statutory provisions of German package travel law.
In the event of insolvency, security is provided by the Security Certificate pursuant to § 651r BGB through R+V Allgemeine Versicherung AG (see Section 2 of these GTC).
The Security Certificate guarantees reimbursement of payments made and, where applicable, necessary repatriation costs.

8.3 Limitation of Liability
Nomad Travel Connectors shall only be liable for damages caused intentionally or by gross negligence.
In cases of slight negligence, liability is limited to breaches of essential contractual obligations and to foreseeable, typical damages.

9. Data Protection
Nomad Travel Connectors processes personal data solely for the purpose of fulfilling the contract and in compliance with applicable data protection laws (GDPR).

10. Applicable Law and Jurisdiction
The contractual relationship is governed exclusively by German law.
The place of jurisdiction is Frankfurt am Main, insofar as legally permissible.

11. Amendments to the GTC
Nomad Travel Connectors reserves the right to amend these GTC at any time with future effect.
The current version is published on the website.
By continuing to use the website after changes take effect, the client is deemed to have accepted the amended terms.
 
12. Image Sources, Copyright and Usage Rights
 
12.1 Definition of “Image Material”
For the purposes of these Terms & Conditions, “Image Material” refers to all photos, graphics, illustrations, videos, and comparable visual content that are created by Nomad Travel Connectors (“NTC”), licensed by NTC, provided by customers, or obtained from external sources (e.g. Pexels, Wix media library, other stock providers).
 
12.2 Customer-Owned and Personal Images
a) Customers may provide NTC with image material (e.g. for customizing travel arrangements, presentations, or social media features).
b) Customers warrant that they hold all necessary rights to the provided image material for its intended contractual use and that such use does not infringe third-party rights.

c) Customers shall indemnify and hold NTC harmless from any claims by third parties arising from unlawful use of the provided image material.
d) Where NTC wishes to use personal image material for marketing, promotional, or reference purposes (e.g. on the website, social media, printed material), NTC will do so only with the explicit consent of the identifiable persons concerned (Art. 6(1)(a) GDPR; §§ 22 et seq. German KUG). Consent is voluntary and may be withdrawn at any time with future effect.
 
12.3 Use of Image Material from External Sources
a) NTC uses image material from royalty-free or licensed platforms (e.g. Pexels, Wix media library) strictly in accordance with the applicable license terms.
b) Where attribution of the creator is required or considered good practice, NTC will provide attribution in an appropriate form (e.g. “Photo: Pexels / Creator’s name”).
c) Because stock platforms such as Pexels do not always guarantee model or property releases, NTC reviews such material carefully. If a rights holder reports an infringement, NTC will promptly remove the material in question (“Notice-and-Takedown” procedure).
 
12.4 Copyright and Protection of NTC Content
a) All content (texts, images, videos, graphics, layouts) created by or commissioned by NTC is protected under copyright law.
b) Use by third parties (download, storage, editing, publication, distribution) is only permitted with NTC’s prior written consent, unless explicitly stated otherwise or legally permitted.
c) Commercial reuse or redistribution of NTC content is strictly prohibited without a separate license agreement.
 
12.5 Notice-and-Takedown Procedure
NTC respects copyright, trademark, and personality rights.
Legal notices regarding content used on NTC’s media channels may be sent to book@nomad-travel.de.
NTC will promptly review any such notice and, after legal assessment, remove or disable access to infringing material without undue delay.


13. Severability Clause
If any provision of these GTC is or becomes invalid, the validity of the remaining provisions shall not be affected.
The invalid provision will be replaced by a valid one that comes closest to the intended economic purpose.
